从“喧嚣”到理性——网络反腐的制度定位与法律体系构建

近年来,网络反腐作为我国公民新型的监督方式与反腐手段,对推进反腐败事业与落实公民民主参政权起到了一定的积极作用。当前对网络反腐作用的发挥取决于公权力的跟进,其法定依据仅为从支配、管理角度出发的政府临时性文件。网络反腐要在真正发挥反腐实效的同时,又兼顾社会公众的其他合法权益,就必须以相对独立的制度定位,在我国当前反腐败制度体系下,进行理性的制度设计,并与权力反腐相互促进,共同走制度反腐的法治化发展道路。
