| 摘 要： | 从历史成因的角度看，知识产权因法律规定而产生，它是一个不断发展的概念，其特征也是处于变动之中，否定或静化知识产权特征都是不科学的。现阶段的知识产权主要特征为排他性、地域性、信息形态性、无形性和可复制性，时间性已不是其主要特征.

| Abstract: | From the perspective of the historical origin, the appearance of the intellectual property rights is due to the provisions of laws. It is a continuously developed concept with changeable characteristics. No act denying or sta- bilizing the characteristics of the intellectual property rights shall be scientific. Currently, the main characteristics of the intellectual property rights are comprised of the exclusivity, regionalism, and formality of information, intangibili- ty and replicability. Timeliness is no longer one main characteristic thereof. |
