论侦查中止的制度构建

在侦查实践中，经常会出现一些特殊情形而导致侦查活动无法继续进行下去，此时既不能终结侦查也不能撤销案件。但是，因为在这方面法律规定的空白而导致在侦查实践中产生了很多问题。规定侦查中止对于解决我国目前在侦查实践中面临的棘手问题不失为了个良策。在刑事诉讼法的修改中有必要对侦查中止的程序在适用条件、审批程序、产生效果、救济程序及恢复侦查等方面进行系统的设计。
