| 摘 要： | 在当前高校毕业生就业形势严峻的背景下，用人单位恶意侵犯毕业生劳动权益问题十分严重。本文通过对毕业生在择业就业过程中实体权利的分析，并结合2008年实施的《劳动合同法》和《就业促进法》，提出毕业生的择业就业权利的具体内容及其保障的方法。
