论“知假买假”能否适用《消费者权益保护法》

摘    要:1993年10月我国颁布了《消费者权益保护法》,其中第四十九条规定:"经营者提供商品或者服务有欺诈行为的,应当按照消费者的要求增加赔偿其受到的损失,增加赔偿的金额为消费者购买商品的价款或者接受服务的费用的一倍。"随着该项条例的颁布,从1995年起在社会上逐渐产生了一批以"知假买假"而获利的"专业打假者"。由于"职业打假者"队伍的不断扩大直接影响到商家的利益,但却得到广大消费者的一致支持,所以,"买假索赔"的消费行为到底能否适用《消费者权益保护法》第49条的问题就引起了广泛的争议。本文就将运用民法解释学原理对这个问题进行初浅的探讨

Abstract:In October 1993,China promulgated the"Consumer Protection Law"in which Article 49 states:"operators provide goods or services with any fraudulent acts should increase compensation for their losses in accordance with the requirements of the consumers,and the amount of compensation for consumers should be doubled by the price of goods or the costs of the service."With the promulgation of the Ordinance,since 1995 there has been gradually a number of"professional fake- goods fighters"profited from"know-fake- buy-fake"in the community.The continuous expansion of"professional fake-goods fighters"directly affects the interests of businessmen,but has the unanimous support of the vast number of consumers.Therefore,whether the behavior of"buy-fake-claim"in the end can be applied to Article 49 of"Consumer Protection Law"caused widespread controversy.This paper discussed on this issue by using the explanation of Principles of the Civil Code 1
