论司法判决的不确定性

一般认为，司法判决是确定的，每个案件都存在着“唯一正确的答案”，这是一个常识性的错误。事实上，在判决的形成过程中，有多种不确定性因素在发挥着作用，因而，判决往往是不确定的。判决的不确定性主要来源于以下四个方面：即法律适用的不确定性、事实认定的不确定性，司法人员个性的不确定性和其他社会因素的不确定性。

The Uncertainty of Judicial Decision

It is generally believed that the judicial decision is absolute that every case has "the only correct solution". This is misleadingly wrong. In effect, a series of factors of uncertainty is contributing to the process in which a judicial decision is taking shape.Consequently, a judicial decision is liable to ha uncertain. The unceratinal of a judicial decision results from the following four aspects: the uncertainty of the application of law, the uncertainty of the identification of facts, the uncertainty of the individualism of judicial people and the uncertainty of some other social factors.
