“盗窃信用卡并使用”的含义解析与司法认定

"盗窃信用卡并使用"中的"信用卡"仅限于真实、有效,能正常使用的信用卡卡片;"使用"是按信用卡特有的电子支付卡的功能加以利用;"盗窃"是指采用秘密窃取的方法取得他人占有之下的信用卡卡片。行为人误认伪卡为真实、有效的信用卡而盗窃并使用的,构成信用卡诈骗罪。使用盗窃的信用卡不以盗窃者本人使用为限,还包含利用第三者使用,故意帮助、教唆第三者使用的情形。盗取他人信用卡信息资料复制信用卡后使用的、盗用他人留置在自动取款机插口内未退出取走的信用卡取款的,不是"盗窃信用卡并使用"的行为,应以信用卡诈骗罪论处。
