| 摘 要： | 建立刑事被害人国家补偿制度是国际刑事诉讼发展的主要趋势，它能有效保障被害人的合法权益。目前我国已具备了建立该制度的现实基础和立法构想，通过该项制度的确立能进一步完善人权保障制度，促进社会和谐发展。

| Abstract: | It is the main tendency that establishing the system of the criminal victim obtaining compensatory from country as the international criminal prosecution develops.This system can safeguards the victim's legitimate rights effectively.At present our country has formed the realistic foundation and the conception in legislation.This system's establishment should consummate the human rights system of safeguards and promote our society developing accordingly. |
