论卓越法律人才的应有素质及其培养路径

三十多年来,我国法学教育成果喜人,但也存在不能适应社会需要等问题。2011年教育部、中央政法委员会发布了《关于实施卓越法律人才教育培养计划的若干意见》,提出要培养信念执著、品德优良、知识丰富、本领过硬的高素质法律人才,也即规定了卓越法律人才的应有素质。就卓越法律人才的培养路径而言,需要学生、教师共同努力,也需要完善体制机制,还应当处理好法学教育与司法考试的关系,与外语学习的关系,与本科课程设置的关系,与法学/法律硕士等的关系,与法科学生职业选择和规划的关系等,并避免几个误区。培养模式和内容卓有成效,是卓越法律人才教育培养计划成功的关键。
