| 摘 要： | 侵犯著作权犯罪在现代社会日趋严重,近年不少国内学者提出利用设置资格刑的方式来遏制这类犯罪。通过借助交叉学科的研究视野,基于SWOT分析方法对侵犯著作权犯罪设置资格刑的SWOT因素和SWOT矩阵进行了分析,认为设置资格刑并非一项简单工作,我们必须从多方面具体策略出发进行设置。

| Abstract: | As copyright infringement crime has become more and more serious in the modem society,in recent years some scholars in our country put forward the idea of using qualification penalty to control this kind of crime.Through the view of intercrossed studies,the SWOT ingredients and matrix of setting up the qualification penalty for copyright infringement crime has been analyzed on the basis of SWOT.Setting up the qualification penalty is not an easy task and we must do it from different concrete strategies. |
