功能与现状视角中的中国民事检察监督

民事检察监督在保障民事法律统一正确实施、实现个案正义、维护司法权威、解决纠纷等方面具有独特功能。就现状而言，其以提出或提请提出抗诉、发出检察建议、提起并参与民事公益诉讼等方式取得了一定成效。但由于立法等原因，民事检察监督存在方式单一、范围局限、效率不高、力度不足等缺陷，需要进一步完善。
