试论我国内地、港、澳三地物权的法律冲突及其解决

物权作为民法中的基本制度 ,在我国内地、香港、澳门的民事立法中存在较大的差异 ,主要表现在 ;物权客体的范围不同 ;物权的种类和内容规定不同 ;物权取得、变更和消灭的规定不同 ;动产和不动产的规定不同。解决内地、香港、澳门三地物权的法律冲突可遵循下面几个原则 :动产和不动产物权均适用物之所在地法 ;运输中的动产物权 ,适用送达地法 ;运输工具物权 ,适用登记地法。

Exploratory Discussion About the Conflicts of law About the Property Rights of the Inland of Our Country, Hong Kong and Macao and Their Settlement

As the fundamental system of civil law, property rights are greatly different in the civil legislations of the inland of our country, Hong Kong and Macao. This mainly demonstrates that: different scopes of the object of property right; different stipulations about the types and content of property right; different stipulations about the acquisition, change and extinction of property right; different stipulations about movable property and immovable property. The settlement of conflicts of law about the property rights of the inland, Hong Kong and Macao can follow the principles below: laws of the place of the object situation apply to the property rights for both movable property and immovable property; laws of the place of destination apply to the property right for the movable property in transportation; the laws of registry place apply to the property right of means of transport.
