中国反规避立法的路径选择

尽管反规避法被滥用时有贸易保护主义的嫌疑,但其本质是反倾销措施的延伸和保障,中国应当立足国情,尽快制定反规避法。欧盟和美国的反规避立法相对完善,中国应积极借鉴他们的立法经验;但其某些规则仍然有失公正,缺乏合理的确定性和透明度,中国应当采用严格的立法标准,克服这些弊病。同时,中国应积极参与并推动世贸组织关于反规避统一规则的谈判,促使世贸组织尽早制定各成员都能接受的反规避规则,避免反规避规则演变为贸易保护主义的新工具。

The Route Choice of Legislation on Anti-circumvention in China

Although there is a suspicion of trade protectionism as anti-circumvention law is abused,its essence is extension and safeguard of anti-dumping measures.China shall constitute anti-circumvention law on the basis of the situation of our country as soon as possible.The legislation on anti-circumvention in EU and America are comparatively mature,China shall use them for reference;But some rules lack in equity,certitude and transparency,China shall adopt strict legislative model to overcome these shortcomings.Simultaneously,China shall take active part in and improve the negotiation on anti-circumvention in WTO,urge WTO to constitute uniform rules in order to avoid anti-circumvention rules transforming to a new tool of trade protectionism.
