国际工程法务问题研究

我国的国际工程法律服务是伴随着国际工程业务的开展而发展变化的。国际工程业务从最初的劳务分包、施工分包到后来的工程总承包,一直到现阶段的EPC+F、BOT、PPP投资,法律服务内容与主体都发生了显著变化。合同或法律服务人员囿于单一专业已经不适应时代发展的需求,培养更高层次的跨学科复合型人才已迫在眉睫。应改革现有的专业学位制度,设置符合国际工程业务发展的专业法律博士学位,以高校为依托,充分发挥全国律师协会的作用,培养以实践型为主、以学术型为辅的复合型国际工程法务领军人才。

Review and Prospect of International Engineering Law

The history of China’s forei gn engineering contracting can be roughly divided into four stages:germination stage,exploration and initial development stage,rapid expansion stage and excessive competition stage.China’s international engineering legal service is developing with the development of international engineering business. International engineering business from the initial labor subcontracting, construction subcontracting,to the later general contracting,to the current stage of EPC+F,BOT,PPP investment,legal service content and subject has also undergone significant changes.The contract or legal service personnel bureau is limited to a single major,which can not meet the needs of the development of the times,so it is urgent to cultivate higher-level interdisciplinary talents.We should reform and develop the existing professional degree system,set up the professional degree of doctor of law in line with the rapid development of international engineering business,rely on Colleges and universities,give full play to the role of the National Bar Association,and cultivate the compound leading talents who are mainly practical and supplemented by academic.
