| 摘 要： | 理论上,共同贪污犯罪可分为国家工作人员共同贪污犯罪和国家工作人员与非国家工作人员共同贪污犯罪两种情形。实践中,对不同情形的共同贪污犯罪,应根据各共同犯罪人的身份及其在共同犯罪中的地位和作用进行具体分析、定性。
