| 摘 要： | 物权法首次用法律的形式确立了我国的浮动抵押制度，这是对我国传统抵押担保制度的重大突破。浮动抵押从性质上看是一种担保物权，具有抵押物的浮动性或流动性、抵押物的集合性、性质的可转化性等特点。研究分析我国的浮动抵押制度。既有利于该项制度的推广使用。又有益于防范其给债权人带来的风险。

| Abstract: | Law on Property establishes the floating mortgage system with the form of law for the first time in our country. This is an important breakthrough to the traditional mortgage guarantee system. According to its essence, the floating to mortgage is a kind of guarantee estate right with the floating feature and liquidity of mortgage, the concentration of guaranty and these features can convert. Analysis of floating mortgage system is good to prevent the risk that it brings to the creditors. |
