| 摘 要： | 在行政执法自由裁量中,价值负荷的“德性”行政人是利益衡量的出发点,法律的适用与法律解释是利益衡量的形式,价值判断是利益衡量的实质,整合法律是利益衡量的功用。当代行政执法中行政人应当积极而审慎地运用利益衡量方法追求善治。
