犯罪心理学研究的核心问题——刑事责任的心理基础

在“刑事一体化”背景下 ,犯罪心理学的研究应以行为人承担刑事责任的心理基础为核心。对故意犯罪而言 ,刑事责任的心理基础主要表现为行为人恶劣的犯罪动机和对法律的蔑视态度 ;就过失犯罪而言 ,刑事责任的心理基础主要表现为行为人人格的缺陷和对法律的轻视态度。因此 ,犯罪动机和犯罪人格是行为人承担刑事责任的主要主观依据 ,也是犯罪心理的具体表现和核心内容。

The Core Problem of the Criminal Psychology--The Psychological Foundation of Criminal Liability

Under the background of the 'unification in the criminal law', study of criminal psychology focuses on the psychological foundation which the actor shall be responsible for. As for the intended crime, the psychological foundation of criminal liability is based on malicious criminal motive and contempt to the criminal law. In addition, in terms of the negligence, what is revealed in the criminal liability is exposed the defect of the criminal personality and in the contemptuous attitude to the criminal law. Thus both the motivation to commit a crime and the criminal personality are one of the chief objective liability for which the criminal shall be responsible, which is also the substantive presentation and key factor reflected in the criminal psychology.
