| 摘 要： | 现有的物权法著作通常把物权变动规范模式分为意思主义、债权形式主义与物权形式主义。该分析框架有明显缺陷,应从物权行为立法选择与公示在物权变动中的法律意义两个维度构建更为精密的新分析框架。现行《物权法》采用的是物权行为否定与公示大折衷主义的规范模式。
