| 摘 要： | 客观解释论符合罪刑法定原则的要求。由于刑法的客观解释是语义解释和语用解释的结合,作为客观解释前提的语义解释划定了刑法文本意义的大致范围,使刑法文本意义得以明确的语用解释须遵守语用推理规则,且刑法解释有一系列制度性制约,因而客观解释不会导致刑法解释和适用的随意性,不违背公民的预测可能性,不会产生侵犯人权的结果。
