分割法:涉外侵权法律适用中的二元价值追求

“正义”与“公平”紧密联系在一起,构成判断实在法适当性的二元价值坐标.涉外侵权法律适用立法也应当以“正义”和“公平”作为确定法律选择方法或规则的价值追求.“行为地法”只能反应“正义”的诉求,不一定能满足“公平”的需要.“公平”的满足还应当考虑与受害人的居所和损害修复地有密切联系的法律.“正义”标准要求判断行为是非主要适用“行为地法”,而“公平”标准要求对侵权行为的处理还应当结合“受害人居所地法”、“法院地法”等其它标准.由此,涉外侵权法律适用被分割为两个方面:行为正当性和救济的公平性,二者应当兼顾.单一采用“行为地法”背离了二元价值追求.

Dépecage:the Value Pursuit in the Application of Law of Foreign Tort

Justice combining with fairness which constitutes dual value coordinates on the appropriateness of substantive law. This dualism coordinates should also be used to ascertain the value of choice rules or approaches in the application of law. Lex loci delicti may only reflect the value of justice, not fairness. In order to satisfy the fairness value, the law of the place of partyg residence or the place of lossrepairing should be considered. Justice requires the application of lex loci de- licti on the fitness issue of act. Fairness coordinate requires the application of the law of victim＇s residence or lex fori. Therefore two aspects on the application of tort law, i. e. , one is the justice of act, the other the fairness of relieve are to be considered. It would be deviated from the dualism coordinates of the application of tort law if only lex loci delicti is applied.
