| 摘 要： | 法律解释活动中，法官选用不同的解释方法会带来不同的解释结果，但法官对解释方法的选用不是任意的，法官的选择受自身价值取向的支配。法律解释中存在价值取向是由一系列的原因决定的，而且价值取向对法律解释活动产生多方面的影响。法官需要做的是依据价值取向对法律的意义进行选择，实现个案正义与社会正义的统一。

| Abstract: | In legal interpretations, different approaches will bring about different results. A judges＇ choice of approach is not random but determined by his value orientation. A series of reasons determine the existence of value orientation in legal interpretations and value orientation affects legal interpretations in various respects. A judge needs to choose the meaning of laws based on his value orientation and thus achieves the unity of justice in a single case and social justice. |
