我国土地征用制度缺陷及改进措施

由于我国土地征用制度存在严重的缺陷,法律规定不完备,导致征地权力运用不规范,土地征用范围不明确,公共利益扩大化,土地征用程序不合理。因此,改革和完善土地征用制度,建立完善的土地征用法规,规范政府的职权,明确土地征用的范围,界定公共利益的内容,改革土地征用程序,使征地制度更加合理。

On the Defects and Improvements of the Land Requisition System

Because of the defects of the Land Requisition System and the imperfection of legal provisions in our country,there are such problems as irregularities of the right to expropriate land,ambiguity of the scope of land expropriation,expansion of public interest,and unreasonable land expropriation procedures. So we should rationally reform and perfect the land requisition system,establish perfect legal system,regulate the government powers,clarify the scope,define the content of public interests,and reform the procedure to make the system more reasonable.
