| 摘 要： | 一、理性看待勞教制度的歷史存在勞動教養,是我國對違法和輕微犯罪人員所採取的一項強制性教育改造措施,也是我國制裁違法犯罪行為的法律手段之一。勞動教養制度產生于建國之初,有其特定的歷史必要性。勞動教養制度建立之初,既是對被勞動教養的人實行強制性教育改造的一種措施,也是對他們安置就業的一種方法。其主旨是為了把遊手好閒、違反法紀、不務正業的有勞動能力的人,改造成為自食其力的新人,以維護公共秩序和有利於社會的建設。建國之後,國家尚未完全統一,
