"法律是什么"之再审视——学说反思与概念修正

法律是现代社会不可或缺的组成部分,然而,关于法律是什么的问题仍然未有定论,梳理和反思学界前辈们关于法律的界定,考量法律存在的目的,有利于通过实证主义的路径来思考现代社会意义中法律的范畴。据此,可以认为,法律是依据主流社会的意志制定或认可,以其共同体的强制力为后盾,规范社会成员的行为、化解社会冲突并创造美好生活的社会规范。

A Re-examination of "What is law"——Academic Reflection and Concept Modification

Law is an indispensable part of modern society;however the question of"what is law"has not been defined.The purpose of sorting and reflecting on the definition of law by previous scholars and ex- amining the existence of law is helpful in thinking about the category of law in the context of modern so- ciety through passivism.Therefore,it can be said that law is enacted or approved by the will of the ma- instream society,and is supported by the force of their community,so as to standardize the conduct of members of the society,to ease social conflict and to create a social norm for a better life.
