知识产权的滥用行为与反垄断法的调控

知识产权中的独占权与反垄断法在维持公平的竞争秩序,刺激劳动者和企业的创造性和保护消费者权益上保持着一致性。两者的矛盾和冲突主要体现在知识产权的滥用行为上。我国应同时借鉴发达国家和发展中国家的立法模式,对国际技术转让中滥用知识产权的行为进行法律规制;对国际技术转让中的限制性商业惯例实事求是进行分析比较,对没有实质危害,或利大弊小的,可经国家审批机关批准订入合同;对那些不公平不合理有害的条款,则应坚决抵制。

On Abuse Behavior of Knowledge Property Right and Adjustment of Antimonopoly Law

The right of monopoly in knowledge property and the antimonopoly law must keep consistent in maintaining the fair competition order,in stimulating the labour's creativeness.All the contradiction can be seen in the abuse behavior of knowledge property right.Our country should use the experience of other countries for reference.We should firmly resolutely resist the unfair and unreasonable provision.
