| 摘 要： | 流浪、乞讨现象的存在,是社会、流浪求乞者以及施舍者多方面的因素共同作用的结果。用法律对此进行规制时,须客观正视诸方面因素,追寻因果链条,设定规范,调整策略。在兼顾秩序和自由的价值的同时,亦可以尝试以新的方式——沟通和说服——来引导、重构流浪乞讨这一社会问题。

| Abstract: | The phenomenon of tramping and begging results from various factors such as society,trampers and benefactors.Therefore,in order to better formulate legal regulations and implement coordination strategies,various factors should be taken into account and cause and effect doctrine be adhered to.Besides guaranteeing the values of order and freedom,such innovative measures as communication and persuasion may also be applied to instructing and reconstructing this social issue. |
