| 摘 要： | 监外执行罪犯脱管、漏管问题是刑罚执行中的一个突出问题。本文通过结合有关实证调研的数据,对当前监外执行罪犯交付执行脱节的表现形式、主要原因进行了分析,并通过引入民法买卖合同中有关"交付"的理论,提出完善监外执行罪犯衔接工作机制,确立监外执行罪犯执行工作"交付"规划的若干对策。

| Abstract: | That criminals outside prison escape from supervision is an extrusive problem. The article analyzes representation form and reasons of disjoint of performance outside prison combining with demonstration study. On this basis, the article puts forward countermeasures of perfecting work mechanism and establishing delivery layout by importing delivery theory of business contract in civil law. |
