论票据丧失后的挂失止付

票据丧失后,如何及时有效地防止票据金额被他人冒领,这是设置挂失止付制度的基本目的。我国现行的挂失止付制度存在很大问题,在今后《票据法》的修订中,可救济的票据范围要严格局限为有权票据,尤其要注意不能将转账票据排除在可救济票据的范围之外。至于通知人,应当是享有票据权利或票据权利行使权的持票人,而受通知人只能是付款义务人。
