| 摘 要： | 在我国古代的刑事司法制度中,未成年人均在不同程度上受到了国家和社会的特殊优恤。这些优恤政策主要是在儒家思想的影响形成的,具体而言是儒家"仁政"、"宽刑"的治国理念和"济贫救弱"、"矜老恤幼"的社会保障思想。在这两种思想影响下,形成了我国古代独具特色的国家、社会、家族三方面协调保护未成年人的制度。

| Abstract: | Minors were usually given preference by the state and society in our ancient criminal system in varying degrees.The preference policies were formed with the influences of confucianism such as the governing concept of benevolent government and clemency,and the social security ideology of helping the poor and the weak,protecting the old and the young.With that,the characteristic minor protecting system were estbalished which coordinated the state,society and family protection. |
