| 摘 要： | 两岸对公司担保之立法不一,祖国大陆的公司法基本上认可公司担保,但对其并无合理限制。我国的公司法针对此不足,文章在分析公司担保之理论可行性的同时,就公司担保的限制及我国公司担保立法的完善进行了阐述。

| Abstract: | Lawmaking that company proceeds guarantee for other civil body in cross-straits is different.Taiwan of China denies the feasibility of company guarantee in principle,and although lack of reasonable restrict,motherland main- land basically admits company guarantee,aims at this lack,article analyzes the theories feasibility of company guarantee. aims at this lack,article analyzes the theories feasibility of company guarantee,at the same time,it discusses company guarantee of restrict and lawmaking's perfect in our country. |
