| 摘 要： | 在司法实务中,对于刑民交错案件是否适用刑事优先原则存在不同的观点,这就导致公安机关、人民检察院和人民法院在对待刑民交错案件的司法处理上出现不一致。针对这一问题,如何根据现有的法律规定并结合司法实践得出一种比较合理的具体规则是一项亟待解决的重要课题。

| Abstract: | In the judicial practice,there are different viewpoints about whether the cases regarding both criminal and civil liability can be applicable to the principle of"criminal priority",and thus it will bring about different results on the judicial handling among the Public Security Organs,the People's Procuratorates and the People's Courts.As for this problem,how to work out a set of reasonable regulations according to the existing law and judicial practice becomes an important task to be settled urgently. |
