| 摘 要： | 转化型抢劫罪转化的前提条件应当为罪,而不是危害行为;在主观条件中存有犯罪目的的双重性;客观条件的确定应当遵循一定的原则;同时是否可以直接适用抢劫罪的加重处罚情节要区别情况而定。

| Abstract: | The precondition of transformed robbery is that it is a crime not a dangerous act. Subjectively the criminal has double criminal purpose and there should be certain principles for the objective condition. It depends on circumstance whether the aggravation of robbery can be directly applied to transformed robbery. |
