| 摘 要： | 行政合同在我国已被广泛运用,但行政合同的诉讼问题却一直未能得到有效解决。行政合同案件应该纳入行政诉讼的受案范围之中。对行政合同案件的审理和判决应该考虑行政合同的行政性和契约性。

| Abstract: | Administrative contract has been applied in wide range. But problems of administrative contract litigation haven't been resolved effectively.The current situation of administrative contract litigation is very chaotic.Administrative contract cases should be brought into administrative lawsuit. Administrative contract's administrative character,contracted character and Administrative Procedure Law should be considered in trials and judicial judgment. |
