| 摘 要： | 百年中国法制发展进程艰难曲折,法观念的更新是百年中国法制之前提。中国法制现代化是历史的必然。法制现代化既包括观念的现代化、制度的现代化,还包括操作的现代化。中国法制现代化首先必须实现三个价值层面的取向:义务本位转向权利本位,制度层面规范政府行为,操作层面的公正合理程序。

| Abstract: | Looking back the extremely hard and bitter struggle s on the development of the Chinese le-gal institution,we got the conclusion t hat the renewal of legal sense is the presupposition,and that the legal moderni zation is inevitable historically.We also got that it contains modernizing sen se and system,still action.More over,to modernize legal system,we must take the trend of three valuable aspects firstly. |
