| 摘 要： | 法律需要经过理解才能得到正确的遵守和执行,我国宪法和有关法律对法律解释作了规定,但实践中还有一些问题值得探讨。本文从法律解释的概念入手,阐述了法律解释的合法性与合理性原则,并从法律解释主体、内容和程序三方面分析了我国法律解释合法性与合理性的程度,最后提出完善我国法律解释制度的建议。

| Abstract: | Only after understanding can law be abide by and enforced correctly. Legal interpretation is stipulated by constitution and the relative law in China. But in practice it exists some problems to be studied. Beginning with the conception of legal interpretation, the paper elaborates the principal of legality and reasonability of legal interpretation, and analyzes the degree of legality and reasonability of Chinese legal interpretation in the subject, content and procedure of legal interpretation respects. Finally it gives some suggestion about how to improve the system of legal interpretation in China. |
