法律视角下高校工会维权的困境与突破

摘    要:维护职工合法权益是工会的基本职责。工会法律地位不独立、工会干部的职业保障权缺乏、集体合同制度规定不明确、人事争议救济制度的不足和法定职责的不履行是当前高校工会维权在法律层面上的困境体现。要改革工会组织体制,赋予工会独立地位;强调源头参与,坚持工会主动维权;拓展维权领域,在突出维护职工经济权益的同时,也要注意民主政治、人身、科技文化教育等方面的权益,实现重点维权与全面维权的统一。

Abstract:To safeguard the legitimate fights and interests of workers is the basic duty of trade unions. The dilemma of college trade union which reflected in the law is that it is not independent in legal status of trade unions, lack job security rights, has no clear regulations on the collective contract system, lack the relief system of personnel dispute and don't perform statutory responsibilities. We should reform the system of trade union organizations to endow trade unions with independent status, stress the source participa- tion, persist in trade union's initiative rights and expand the fidd of maintaining rights. While giving prominence to safeguarding their economic interests, we should also pay attention to democracy, personal, technological and cultural interests, to achieve the consolidation of focusing and comprehensive right - maintaining.
