| 摘 要： | 精神损害赔偿作为我国一项重要的民事法律制度,目前尚存在着一定的局限性。本文从我国民法的基本理论出发,对精神损害赔偿制度中存在的若干问题进行了分析,认为对精神损害赔偿主体应进行合理界定;对精神损害赔偿范围应从人格权、身份权以及国家赔偿等多角度做适度拓展;对赔偿标准应在理解立法原意的基础上,结合我国的司法实践进行正确把握。

| Abstract: | Of the emotional damages compensation, as one of the civil law institutions in China, its limitations still exist. The author analyzes some questions existing in the institutions of emotional damages compensation and concludes that the subject of compensation should be reasonably defined, the range of compensation should be properly enlarged and the standard of compensation should be correctly grasped. |
