理念与选择：劳动法如何照耀家政工人

是否应该将家政工人纳入劳动法律保护范围,并给予家政工人劳动法之＂工人＂身份和待遇是各个国家和地区立法的重要难题。从比较法来看,世界范围内对家政工人劳动权益保护主要有民事法律保护、劳动法保护、专门法保护以及民事——劳动法律协同保护四种模式。然而,家政工人所具有的不同于一般工人的差异性决定了专门法保护模式的合理性和正当性。我国立法应该将家政工人纳入劳动法律体系中保护,颁布《家政工人劳动权益保护法》,提升我国家政工人的地位和待遇,促进家政产业的发展。

Idea and Choice：How Labor Law Protects Domestic Worker＇s

It is a dilemma for legislator to make a choice whether domestic workers are regulated by labor law or not.In the international perspectives,domestic workers are covered by civil law,or labor law,or special law,or comprehensive regulations in different countries and territories.However,the differences from formal workers make it reasonable to enact the special legislation for domestic worker.Therefore,the special legislation for domestic workers in China should be formulated for boosting the sector in domestic service.
