| 摘 要： | 在非诉讼纠纷解决机制中,由行政机关担任居中裁判主体的行政解纷机制因具备多重价值而逐渐凸显出优于其他解纷机制的特点。但事实上,行政解纷机制理论预期上的优势却尚未能在实践中得以全面实现,即尚未发挥其最大效能。若以自治为行政解纷机制构建之基石,以法治为行政解纷机制运行之保障,二者的契合将使行政解纷机制效能最大化的实现得以可能。
