我国海洋行政程序立法法典化研究

我国海洋行政程序法的定位是：海洋行政程序法是海洋行政法的程序法，是行政程序法的特别法，也是海洋程序法的子法。法典化路径理应成为我国海洋行政程序立法的必由之路，有利于回应海洋行政程序法体系之现存问题，有利于强化执法主体的程序义务保障相对人的程序权利，有利于克服行政程序法侧重普遍规则而缺乏特殊规则的局限，有利于各海洋执法主体遵循同一程序进而提升执法能力。统合后的海洋行政程序法是宪政环境下以海洋行政法律体系为依托，属于其内在体系且在适用效力上仅次于宪法，并与其他海洋程序法平行适用的分支法律。以此定位为主线，从海洋执法程序理论与立法技术的高度对该法典的实质内容与结构进行合理设置。

A Study on Codification of China' s Maritime Administrative Legislation

The position of China＇ s maritime administrative procedure legislation is： maritime administrative procedure law is the procedure law of maritime administrative law, the special law of administrative procedure law, and also the sub-law of maritime procedure law. The path of codification should be the only way of China＇ s maritime administrative procedure legislation, which will help to respond the current problems of the system of maritime administrative procedure law, to strengthen the obligations of enforcement subject and protect the rights of the counterpart, to overcome the limitation of lacking of special rules and to upgrade the ability of enforcing law. The unified maritime administrative procedure law is the sub-law which will be applied in parallel with the other maritime procedure laws and its effectiveness is only next to the Constitution. Subject to this position,the substantive containing and structure of this code should be installed reasonably combining with the theory of maritime law enforcement procedure and legislation technology.
