| 摘 要： | 面对日益严重的虚假医疗广告，单纯依靠行政手段采取"一刀切"而予以全面取消的方式显然不符合法治社会的理性要求，在现行的相关行政性法律、法规不足以对其予以有效规制、而我国现行刑法典中关于虚假广告罪的规定也并不适用于虚假医疗广告的情况下，为有效遏制不断蔓延的虚假医疗广告，应当增设虚假医疗广告罪。

| Abstract: | With more and more serious false medical advertisements,it is not in accordance with the rational requirements of the society ruled by laws to abolish them completely only by means of administrative measures.Under the conditions that the prevalent administrative laws and stipulations can not control the false medical advertisements effectively and that the current stipulations on crimes of false advertisement in criminal law do not fit in with the false medical advertisements in reality,crimes of false medical advertisement should be added in order to control the increasing false medical advertisements effectively. |
