| 摘 要： | 死亡赔偿金是根据对受害人的预期收入进行合理的估算后对其继承人的财产损失的一种补偿，其数额的计算必须真正能够体现被害人的收入状况，才能够真正维护其继承人的财产权利。因民事主体个体能力有差异，死亡赔偿金数额的计算不能订立同一标准，应允许合理差别。

| Abstract: | Death compensation is a kind of compensation to the heir of the dead person on his property loss based on the reasonable assessment according to the victim＇ s expected income, its calculation must reflect the victim＇ s income situation, it also really protect his heir＇ s property right. The calculation criterion death compensation can not been calculated in a single criterion for the different person＇ s ability, the reasonable difference shall be prevail. |
