论我国国家工作人员财产申报制度的立法完善

官员贪污腐败现象是当今世界各国普遍存在的一个痼疾,各国也都无一例外地将惩治贪污腐败作为一项长期的重点治理工作。国家工作人员财产申报制度是预防和惩治官员贪污腐败行为的一项行之有效的法律保障制度,在国外已经形成了较为成熟的立法和执法经验,被称之为“阳光法案”。在《中华人民共和国公务员法》立法过程中,国家工作人员财产申报制度就曾倍受关注,但遗憾的是最终未能将其列入。在当前反腐败斗争任务仍任重道远的情况下,应尽快将这一制度纳入公务员法或单独进行立法。

On the Legislative Perfection of Declaration System of Property of State Functionaries in Our Country

The official corruption is an aeipathia of all the countries in the world nowadays, and every country has taken it as a long-term issue to control and punish. The Declaration System of State Functionaries is an effective legal regulation to prevent and punish it. As for this, there has formed the comparatively mature legislation and legal experiencing abroad, which is called "sunlight code". When our government formulated the Public Servant Law of the People's Republic of China, it had attracted close attention, but regretfully failed to list in the Law. Under the situation that the current struggle against corruption still takes a heavy burden on a long road, it should be listed into the public servant law or make its legislation alone as soon as possible.
