| 摘 要： | 2007年10月1日施行的物权法首次用法律的形式确立了善意取得制度。善意取得制度对维护市场经济秩序、保护善意第三人的合法权益、维护交易活动的动态安全,具有重要的意义。文章通过对善意取得制度的历史沿革的介绍,在分析我国现行法上的善意取得制度的基础上,指出了善意取得的构成要件及法律后果,以期对完善我国善意取得制度的架构、推进相关制度的研究有所裨益。
