| 摘 要： | 集中土地进行公共项目的开发是公共利益和经济发展的必需,但又极大地威胁着私人财产权的安全。纽约市的征收程序设置了大量的听证程序,一个公共项目经过至少3-4次的公众听证会,每个决策和建议机构充分听取被征收人和公众的意见后,才会被决策。听证程序给予公民表达意愿的机会,牵制了征收权的滥用,增加了政府行政的透明度,减少了民众与政府的摩擦,从而达到平衡征收权和私人财产权的目的。
