| 摘 要： | 授权立法是立法权行使的重要方式之一 ,合法性则是法治原则对授权立法的基本要求。授权行为本身能否合法成立则是衡量授权立法是否合法的重要依据。授权主体只能在合于法律目的前提下 ,依照法定程序将宪法赋予自己且可依法转授的立法权进行转授 ,才能产生法律上的拘束力。在权力被授出之后 ,授权主体也可能通过行使所授之权 ,或者通过撤销决定的方式 ,使授权归于消灭。

| Abstract: | The authorized legislation is one of the major ways that the right of legislation can be applied. The validity is the basic requirement to it. The legal effectiveness will no come into being until the right of legally sub-authorized legislation is sub-authorized according to Constitution. |
