| 摘 要： | 我国的人民陪审制度由于法律规定过于笼统,导致人民陪审制度流于形式,陪审员“陪而不审,合而不议”。应通过明确我国人民陪审员产生方式条件、陪审案件范围,确定人民陪审员权利义务,建立专家陪审制度等来完善人民陪审制度。

| Abstract: | Because the legal rule is too general,our country people jury system becomes a mere form.The jurors just "accompany instead of examining,gather instead of discussion".We should improve the people jury system through clearing selection of the jurors,the scope of the cases,the rights and duties of the jurors,and establishment of the expert jury system. |
