| 摘 要： | 一、问题的提出
自环境问题产生以来，侵权行为法一直担当着解决环境纠纷的重任。从环境法的发生学角度，正是为了应对运用传统侵权行为法理论无法完全解决因环境问题而产生的纠纷的难题，才出现了环境法这样一个新兴的法律领域。这表明，环境法与侵权行为法有着天然的联系：一方面是侵权行为法应对环境问题的不足而产生了环境法，另一方面是环境法又促进了侵权行为法的发展。

Ever since the debut of environmental problems, the law of torts has always been playing the important role of settling environmental disputes. Speaking from the perspective of＂genetics＂ of environmental law, it is for the sake of dealing with the difficult question of how to settle disputes arising from environmental problems that cannot be completely solved through application of the theory of traditional law of tortsξ》, that environmental law has emerged as a burgeoning realm of law. |
