解除原因视角下的合同解除损害赔偿范围研究

解除合同与损害赔偿可以并存,但我国现行立法并未对赔偿范围作出任何规定。由于合同解除原因的多样性,导致在合同解除时,损害赔偿责任的范围并不能简化为信赖利益损失的赔偿或者债务不履行的赔偿,而是应当考虑不同的合同解除情形的特殊性,给予个别化的处理,而且基于合同解除而产生的损害也应当给予赔偿。

Study on Scope of Damages Caused by Dissolution of Contract from the Perspective of Reasons of Dissolution

Since the diversity of reasons for dissolution of contract result in the lifting of the contract,the scope of damages cannot be simplified as the compensation of trust-interests of damages of default,but should be considered in the context of different situations of contract dissolutions,individualized treatment shall be given.Moreover,the damages caused by contract dissolution should also be paid.
